Retrieving Belongings After an Abusive Relationship

Needing to go back for belongings, sometimes important documents, clothes, or items for children, can feel like its own obstacle to leaving, separate from the decision to leave itself. You’re not wrong to take that seriously. Here is a general overview of how this is often handled, though the specifics vary a lot by where you live.

Civil Standby With Local Police

In many areas, local police departments offer what’s sometimes called a civil standby: an officer accompanies you to a residence, usually one time, so you can safely retrieve belongings. This is often available even without a court order, though policies differ between departments, so it’s worth calling your local police department’s non-emergency line to ask what they offer.

With a Protective Order

If you have, or are seeking, a protective order, you can often ask the court to include a specific term authorizing police to escort you back to retrieve belongings on a set date and time. This tends to be the most reliable option where available, since it’s formalized rather than left to a department’s general policy.

What’s Usually Not Covered

Civil standby arrangements are generally built for a single trip to collect personal items and clothing, not for moving large furniture or handling a full move, which can take significantly longer. If you expect to need more than one trip or help with larger items, ask your local police or an advocate about what’s realistic in your area before you plan around it.

Where to Get Guidance Specific to Your Situation

A domestic violence advocate can help you think through timing and safety for this kind of trip, and an attorney can advise on whether a protective order term makes sense for you (see What to Ask a Lawyer About Separation, Housing, and Shared Finances).
